These Terms of Service (“Terms”) govern your access to and use of the Local Essex website at localessex.org and its related subdomains (the “Site”), operated by Local Essex (“Local Essex,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
Local Essex is a free online directory that helps residents of Essex County, New Jersey discover and support local businesses. We offer free basic business listings and optional paid Featured profiles with additional placement and services.
If you submit a business for listing, you represent that you are authorized to do so and that the information you provide is accurate and not misleading. You grant Local Essex permission to display, format, and promote your listing on the Site and in related materials. We reserve the right to edit, decline, suspend, or remove any listing at our discretion, including listings that are inaccurate, unlawful, or inconsistent with the purpose of the Site.
Featured profiles are offered on a paid, annual basis at the rate stated on the Site at the time of purchase. Fees are billed for the applicable term. Unless otherwise stated or required by law, fees are non-refundable once a Featured profile has been set up. We may change pricing for future terms with notice on the Site.
You agree not to use the Site to: violate any law; post false, misleading, or fraudulent content; infringe the rights of others; transmit spam, malware, or harmful code; attempt to gain unauthorized access to the Site or its systems; or interfere with the proper functioning of the Site.
The Site, including its design, text, graphics, and logos, is owned by Local Essex or its licensors and is protected by applicable intellectual property laws. Business names, logos, and content submitted by businesses remain the property of their respective owners, who grant us a license to display them as part of the directory.
The Site displays business information and links to third-party websites. We do not control and are not responsible for third-party content, products, services, or websites, and a listing or link does not constitute an endorsement. Any dealings you have with a listed business are solely between you and that business.
The Site and all listings are provided on an “as is” and “as available” basis without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted or error-free, or that business information on the Site is accurate, complete, or current. You use the Site and rely on any listing at your own risk.
To the fullest extent permitted by law, Local Essex and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising out of your use of, or inability to use, the Site or any listed business.
You agree to indemnify and hold harmless Local Essex and its operators from any claims, damages, liabilities, and expenses arising out of your use of the Site, your content, or your violation of these Terms.
We may modify or discontinue all or part of the Site at any time. We may also update these Terms from time to time; when we do, we will revise the “Last updated” date above. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Essex County, New Jersey.
